Terms, Conditions and Acceptable Use Policy

It is the responsibility of all Host Annex members
to provide and maintain valid and active contact information, including
e-mail address and telephone number. If a member's contact information
is not kept current, and e-mail messages are returned undeliverable,
Host Annex reserves the right to delete the entire account with
member forfeiting all hosting fees.
NO SPAM!!!
Host Annex reserves the right to turn
off your entire account without notice if we find any kind of spam
or unsolicited e-mail containing ANY reference to Host Annex, our network,
our web site, your domain, or any other connection that leads the recipient
of this mail to your account, to us, or to our network. You will lose
your web site(s), and forfeit your hosting fees. These practices
will not be tolerated.
Spam sent by individuals or organizations purporting
to be associated with Host Annex, should immediately be forwarded to
abuse@HostAnnex.com.
Host Annex's general policy is to act
as a neutral provider of access to the global Internet; however, we
reserve the right to suspend or cancel a customer's access to any or
all services provided by Host Annex when we decide that
the account has been inappropriately used.
Specific Acceptable Use Policies
Unauthorized Use of Other People's Accounts or Computers
Host Annex may take preventive measures, including changing
the access password, in the event there is any use or attempted use
of an Internet account or computer without the owner's authorization.
Such attempts include "social engineering" (tricking other
people into releasing their passwords), password cracking or security
hole scanning.
Any unauthorized use of accounts or computers by a Host
Annex customer, whether or not the attacked account or computer
belongs to Host Annex, will result in action against the
attacker. Possible actions include warnings, account suspension or cancellation,
and civil or criminal legal action.
Commercial Advertisements with E-mail
Unsolicited commercial advertisements are not allowed in e-mail, and
will likely result in account suspension or cancellation.
Commercial advertisements are unwelcome in most Usenet
discussion groups and on most e-mail mailing lists. Inappropriate posting
may result in account suspension or cancellation. See the newsgroup
or mailing list's charter for whether advertising is allowed or not.
"Spamming," or sending a message to many different off-topic
newsgroups, is particularly unethical and will be treated as such.
Sending a message to a group, especially an advertisement,
is considered spamming unless the individuals have specifically requested
to be added to a mailing list on that topic.
Abuse of Traffic, Bandwidth or Storage
The intention of Host Annex is to provide space to serve
web documents, not an off-site storage area for electronic files. All
web pages (html) must be 'linked' with files (.gif, .jpg, .exe, etc)
stored on Host Annex's server.
Payment Policies For Services
All accounts are charged in advance. Customer's accounts are automatically
charged each month. Setup and hosting fees are non-refundable.
All pricing is guaranteed for the term of the prepayment. Host
Annex reserves the right to change prices at any time. Payment
is due on each anniversary period following the date the account was
established. Any account not brought current within a week of e-mail
notification or exceeding this time frame in any way is subject to suspension
and/or deletion. The customer is responsible for all money owned on
the account from the time it was established to the time that the customer
notifies Host Annex in writing for a request of
termination of services. Any payments made prior to this request will
not be refunded. Checks returned unpaid (NSF) will be assessed
a charge. All payment is in U.S. currency.
Cancellation
Host Annex reserves the right to cancel service at any
time. Customers can cancel service with thirty (30) days advance written
notice prior to the end of each prepaid term. Although canceling of
service will stop the automatic renewal of a new term of service, it
can not affect prior terms and will not result in a refund for fees
paid on the setup or completion of prior or existing terms of service.
Due to security concerns, all account cancellations must be done in
writing via US mail or fax with a valid signature of the primary contact
of the account, account name, reason for cancellation, and last 4 digits
of credit card on file. If payment was made by check or bank transfer,
include the zip/postal code of the primary contact.
Lawful Purpose
Host Annex reserves the right to refuse service to anyone.
Customers may only use Host Annex's server for lawful
purpose. Transmissions of any material in violation of any Federal,
State or Local regulation is prohibited. This includes, but is not limited
to copyright material, material legally judged to be threatening or
obscene and material protected by trade secrets.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Host
Annex harmless from any and all demands, liabilities, losses,
costs and claims, including reasonable attorney fees asserted against
Host Annex, its agents, its customers, officers and employees,
that may arise or result from any service provided or performed or agreed
to be performed or any product sold by customer, its agents, employees
or assigns. Customer agrees to defend, indemnify and hold harmless Host
Annex against liabilities arising out of; (1) any injury to
person or property caused by any products sold or otherwise distributed
in connection with Host Annex's server; (2) any material
supplied by customer infringing or allegedly infringing on the proprietary
rights of a third party; (3) copyright infringement and (4) any defective
products sold to customer from Host Annex's server.
Disclaimer
Host Annex will not be responsible for any damages your
business may suffer. Host Annex makes no warranties or
any kind, expressed or implied for services we provide. Host Annex
disclaims any warranty or merchantability or fitness for a particular
purpose. This includes loss of data resulting from delays, non-deliveries,
wrong delivery, and any and all service interruptions caused by Host
Annex and its employees. It is highly recommended
that the customer keep current copies of their web pages/files on their
own computer. Host Annex reserves the right to revise
its terms, conditions and acceptable use policy at any time.
